Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Browser Game Site fantasy football platform, websites, apps, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Services.

1) Who we are

"Browser Game Site," "we," "our," or "us" refers to the operator of the Services. References to "you" or "your" mean the person using the Services.

2) Eligibility and age

• You must be 18 years or older to use the Services.
• By using the Services, you confirm you meet all eligibility requirements under applicable law.

3) Account registration and security

• You may need an account to access certain features. You agree to provide accurate, up-to-date information and to keep your credentials secure.
• You are responsible for all activity that occurs under your account. Notify us immediately of any suspected unauthorized use.
• We may refuse registration, suspend, or terminate accounts that violate these Terms.

4) Fair play and acceptable use

You agree not to:

• Use bots, scripts, automation, or any method that gives an unfair advantage.
• Exploit bugs, vulnerabilities, or manipulate scoring, transfers, or league outcomes.
• Harass, abuse, defame, or otherwise harm others.
• Upload or share content that is unlawful, offensive, infringing, or violates third-party rights.
• Reverse-engineer, decompile, or attempt to access the Services' source code except as permitted by law.
• Circumvent security, usage limits, or access controls.

We may investigate suspected violations and take action, including warnings, point adjustments, suspension, or termination.

5) Gameplay, leagues, and scoring

• The Services provide a fantasy football experience based on real-world matches.
• Rules (including squad sizes, captaincy, transfers, deadlines, and scoring) are described within the platform and may be updated from time to time for fairness, integrity, or technical reasons.
• We may correct obvious scoring errors, revert outcomes affected by data issues, or adjust rules to maintain balance and fair competition.
• Private leagues are administered by their creators/moderators; they may set additional rules so long as they do not conflict with these Terms.

6) Virtual items and features

• We may offer virtual items or features (e.g., boosters, themes, season passes). These have no real-world monetary value, are non-transferable, and may be revoked if obtained fraudulently or in breach of these Terms.
• All sales of paid features, where offered, are final to the extent permitted by law. Statutory consumer rights remain unaffected.

7) Payments (if applicable)

• Pricing, taxes, and billing terms are shown at checkout.
• You authorize us (and our payment processors) to charge your selected payment method for purchases you make.
• We may change prices or introduce new charges with prior notice where required by law.
• Refunds are handled in accordance with applicable consumer protection laws and any in-app refund flow.

8) Content you share

• You retain rights to content you submit (e.g., names, messages, images) but grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, modify, and distribute it solely to operate and improve the Services.
• Do not submit content you do not have rights to, or that violates law or these Terms.
• We may remove or restrict content that appears to breach these Terms.

9) Intellectual property

• The Services, including software, design, text, images, trademarks, and logos, are owned by us or our licensors and are protected by intellectual property laws.
• Except where permitted by law or by written permission, you may not use our IP for any purpose other than personal, non-commercial use of the Services.

10) Privacy

Your use of the Services is governed by our Privacy Policy, which explains what data we collect and how we use it. Please review it carefully. Where required, we will obtain your consent for certain processing and cookies.

11) Availability and changes

• We aim to keep the Services available and accurate, but we do not guarantee uninterrupted access, error-free operation, or precise data.
• We may modify, suspend, or discontinue any feature at any time (for example, for maintenance, updates, or to comply with law).
• We may update these Terms to reflect changes in our Services or legal requirements. We will provide notice of material changes as required by law. Your continued use after the effective date constitutes acceptance of the revised Terms.

12) Third-party services and links

The Services may include links or integrations with third-party platforms. We are not responsible for their content, terms, or policies. Your use of third-party services is at your own risk.

13) Disclaimers

• The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
• We do not guarantee specific outcomes, rankings, prizes, uninterrupted availability, or that the Services will meet your expectations.

14) Limitation of liability

To the fullest extent permitted by law:

• We will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or business interruption arising out of or related to your use of the Services.
• Our total liability for any claims under these Terms shall not exceed the amount you paid (if any) for access to paid features in the 12 months preceding the claim, or EUR 50 if no payments were made.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., for fraud or willful misconduct).

15) Indemnity

You agree to indemnify and hold harmless Browser Game Site and our affiliates, officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Services.

16) Termination

• You may stop using the Services at any time and, where available, delete your account in the app.
• We may suspend or terminate access (with or without notice) if you breach these Terms, create risk, or cause harm to other users or the Services.
• Upon termination, your right to use the Services ends, but the following provisions survive: 8 (Content License), 9 (IP), 13–17 (Disclaimers, Liability, Indemnity, Governing Law, Disputes), and any others that by nature should survive.

17) Governing law and disputes

• These Terms are governed by the laws of Poland and applicable EU law, without regard to conflict-of-law rules.
• If you are a consumer residing in the EU, you also enjoy any mandatory protections afforded to you by your country of residence.
• You agree to first attempt to resolve disputes informally. If unresolved, disputes may be brought before the competent courts in Poland, unless mandatory consumer venue rules provide otherwise.

18) Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.

19) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

20) Entire agreement

These Terms, together with the Privacy Policy and any rules presented in-app (e.g., league or scoring rules), constitute the entire agreement between you and us regarding the Services.
